About typical violations when fulfilling the requirements of the legislation on conformity assessment

For more than three years, the Grodno Regional Inspectorate of Gosstandart has had a department of state control over compliance with legal requirements for conformity assessment. The main activities of the department are monitoring compliance with national legislation on conformity assessment, and, compliance monitoring, concerning mandatory confirmation of compliance with the technical regulations of the Customs Union, Eurasian Economic Union.

During the control (oversight) activities, carried out by the department at business entities, numerous violations are established. So, according to the results of the work for 2023 year, illegal acceptance by business entities was established (issuance by certification bodies) 836 conformity assessment documents.

The main violations based on the results of the analysis of conformity assessment documents are::

– evidentiary materials (test reports) do not fully contain research results (test), confirming compliance with the safety requirements of technical regulations, ie. products are not tested for all safety indicators, established in technical regulations;

– incorrect choice of conformity confirmation scheme;

– entering incomplete or unreliable information into conformity assessment documents;

– standard samples were incorrectly selected when confirming the conformity of a wide range of products of the same name;

– test methods are violated, including the procedure for sampling products.

The main reason for violations is the formal approach of applicants to the issues of confirming product compliance with established requirements. Separately worth noting, that a large number of violations are recorded in those cases, when economic entities of our country, carrying out the conformity assessment procedure, use the services of third party intermediaries, which are not certification bodies and do not have their own laboratories. These organizations provide services to support compliance confirmation procedures. In this case, tests are carried out, usually, outside the Republic of Belarus, And it doesn't always happen within the law.. The customer receives a document of compliance (declaration of conformity or certificate of conformity). At the same time, test reports, selection acts and other documents (depending on product) don't get it, which is also a violation of the compliance confirmation procedure. According to technical regulations of the CU (YeAES) the set of documents must be kept by the applicant for at least 10 years from the date of withdrawal (termination) from production or 10 years from the date of sale of the last product of the production batch, passed the conformity confirmation procedure.
